Copyright is a big area with lots of grey bits. There are certain freedoms for news reporting which don't apply to other types of commercial use. There was a classic example of this, right here on A.R.S.E., when norbs saw one of his images being used in a bank ad without his permission.
In contrast I'm not sure the SMH case actually breaches any laws.
